Supreme Court Hears Same-Sex Marriage Case

 

In early October, oral arguments in the same sex marriage reference began in the Supreme Court of Canada. The Court has been asked by the Federal government to examine the constitutionality of a draft bill to legalize same sex marriage while providing protection for those who refuse to perform them for religious or conscientious reasons. Over twenty intervenors participated in the oral arguments.

CCLA focused on answering the claims of some religious organizations that the legalization of same sex marriage would violate their right to equality and compromise their religious freedom. CCLA Special Counsel Andrew Lokan argued that "defining the secular institution of civil marriage in terms that do not happen to coincide with a particular conception of a divine will does not threaten the legitimate interests of religious groups or individuals."
